Terms of Service

These Terms of Service ("Terms") govern your use of the Mohalla mobile apps, web portal and related services (the "Service"), provided by [Registered legal entity name] ("Mohalla", "we", "us" or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and a resident, member, committee member, guard or authorised staff of a society that uses Mohalla. By using the Service you confirm that the information you provide is accurate and that you are authorised to join the society and unit you request.

2. Your account and sign-in

You sign in with your mobile number and a one-time password (OTP), and you may set a PIN on your device. You are responsible for keeping your device, PIN and OTP secure and for all activity under your account. Do not share your OTP with anyone. Tell us or your society admin promptly if you suspect unauthorised access.

3. Society membership and approval

Mohalla connects you to your society. Your membership, unit assignment and role are subject to approval and management by your society's administrators. Admins may approve, decline, suspend or remove access, and may control the features available to residents, guards and staff. Mohalla is a platform provider and is not responsible for your society's internal decisions.

4. Acceptable use

You agree not to:

  • Enter false, misleading or fraudulent information — including fake visitor details or another person's identity.
  • Use the Service to harass, threaten, defame or harm others, or to post unlawful, obscene or hateful content.
  • Attempt to gain unauthorised access to accounts, societies, data or systems, or interfere with the Service's security or operation.
  • Copy, scrape, reverse-engineer, resell or misuse the Service or its data, except as allowed by law.
  • Use the Service for any purpose that is illegal or that violates the rights of others or your society's rules.

5. Your content

You keep ownership of the content you submit — such as complaints, announcements, messages, documents and images. You grant Mohalla a licence to host, store, display and process that content as needed to operate the Service (for example, showing your complaint to your society's admins). You are responsible for the content you submit and confirm you have the right to share it. We may remove content that violates these Terms or the law, and your society's admins may moderate content within their society.

6. Payments, dues and billing

  • Maintenance charges, dues, fines and any late fees are set, invoiced and managed by your society, not by Mohalla. Questions about a specific charge should go to your society committee.
  • Online payments are processed by a third-party payment gateway (Safepay) under its own terms. You are responsible for providing accurate payment details.
  • Mohalla does not itself charge residents for maintenance and does not issue refunds for society dues — refunds, adjustments and waivers are handled by your society under its own rules.
  • Any fees payable by a society to {LEGAL.service} for the platform are governed by the separate agreement between {LEGAL.service} and that society.

7. Visitor management and security

The visitor-management and gate features are tools to help societies record and manage visitors. They assist with, but do not guarantee, security. Mohalla is not a security service and is not responsible for the conduct of visitors or for physical security at any premises. Always follow your society's security procedures.

8. Mohalla AI assistant

The in-app assistant provides information and convenience based on your society's data. Its responses may be incomplete or inaccurate and are provided for general information only — they are not professional, legal, financial or safety advice. Verify important information before relying on it.

9. Third-party services

The Service relies on third parties (such as SMS/WhatsApp delivery, cloud hosting, the payment gateway, push notifications and the AI provider). Your use of those features may also be subject to the third party's terms. We are not responsible for third-party services we do not control.

10. Intellectual property

The Service, including its software, design, branding and content (other than your own content), is owned by Mohalla and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not use our name or logo without permission.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or fully secure, or that notifications and messages will always be delivered.

12. Limitation of liability

To the maximum extent permitted by law, Mohalla and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of (or inability to use) the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnity

You agree to indemnify and hold Mohalla harmless from claims, losses and expenses arising out of your content, your use of the Service, or your breach of these Terms or of applicable law.

14. Suspension and termination

You may stop using the Service at any time. We (or your society admins, within their society) may suspend or terminate access if you breach these Terms, misuse the Service, or where necessary to protect residents or the Service. Some provisions — including content licences already granted, payment obligations, disclaimers and limitations of liability — survive termination.

15. Changes to the Service and these Terms

We may change or discontinue features, and we may update these Terms. When we make material changes to the Terms, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan. You agree that any dispute relating to the Service will be subject to the exclusive jurisdiction of the courts of Pakistan, without prejudice to any mandatory consumer protections available to you under applicable law.
